Il corso verrà svolto attraverso lezioni a contenuto teorico, esercitazioni e attività seminariale di approfondimento. Sono previste inoltre integrazioni per lo studio di casi pratici.

Le fonti del diritto di famiglia. La famiglia nella disciplina del codice del 1942: i principi costituzionali in materia di famiglia. La riforma del diritto di famiglia. Il matrimonio civile. Il matrimonio concordatario. La modifica del Concordato Lateranense. La famiglia di fatto. Il contratto di convivenza. Unioni civili. I diritti ed i doveri nascenti dal matrimonio. Il dovere di contribuzione. L’accordo tra i coniugi ed il governo della famiglia. La disciplina dei rapporti patrimoniali tra i coniugi. Il regime legale e le convenzioni matrimoniali. L’impresa familiare. L’invalidità del matrimonio ed il regime del matrimonio putativo. La separazione dei coniugi. Il divorzio. Il rapporto di filiazione e lo status unico di figlio dopo la legge 10 dicembre 2012, n. 219. L’adozione. La responsabilità genitoriale. L’affido ai servizi sociali. Learning Evaluation Methods.

The examination consists in an oral test.


Learning Evaluation Criteria.

During the oral examination, students will have to demonstrate that they have acquired a solid knowledge of the principal institutes analyzed, their recognized functions and related interpretation issues. They will also have to demonstrate that they have understood the purpose and the possible use of the main tools of the program.


Learning Measurement Criteria.

the vote will be expressed in thirtieths. The student will pass the exam if he or she gets at least 18. There is a maximum rating of 30 with praise (30 and praise).


Final Mark Allocation Criteria.

The test is oral and will take place in the interview mode. Voting sufficient requires the demonstration of a knowledge of the topics of conversation and of a proper language property. Students who will demonstrate critical and analytical skills as well as comprehensive and exhaustive understanding of the theoretical and practical content of the topics discussed will receive praise.
