MODALITÀ DI SVOLGIMENTO DEL CORSO DEVELOPMENT OF THE COURSE

The course will be carried out through lectures with theoretical content and seminars. There will be also workshops for the study of cases.

RISULTATI DI APPRENDIMENTO ATTESI LEARNING OUTCOMES
Knowledge and Understanding.

The course aims to critically examine the main legal issues arising from the development and application of information and communication technologies, analyzing how law can address and solve the challenges that new technologies pose to humanity, and seize their opportunities. The complex relationship between science, technology and law will be explored through the analysis of how the technological revolution is changing the legal systems in terms of general principles and specific institutions, infusing new values in contemporary systems.


Capacity to apply Knowledge and Understanding.

At the end of the course students will be able to:
-gain awareness of the theoretical and practical elements of the possible uses of information technologies in legal activities and in the economy, thereby critically evaluating the implications on law and society;
- apply the fundamental principles of information technology in the legal area, focusing in particular on contractual issues;
-identify, analyze and solve legal problems arising from the latest technological developments;
-develop new knowledge in relation to changing technologies and their national and international regulatory frameworks.


Transversal Skills.

Practical applications, comparisons and discussions, which will take place during the course, will allow students to improve their autonomy and their skills in terms of communication, learning and critical approach, also by using databases.

PROGRAMMA PROGRAM

From digital to digitalism: the transformation of human experience into a compatible format (numbers) through the use of machines;
The position of the so-called traditional law in front of the machine-internet-web system: lex informatica and lex mercatoria;
Basic principles of contract law;
IT contracts: hardware contracts, software user licence and development license, other IT contracts;
The science of algorithms, computational complexity, and necessary approximation;
Evolution of algorithmic models (deep learning). Insufficiency of the perspective of the right of access and/or that of the comprehensibility of the logics underlying the algorithm.

MODALITÀ DI SVOLGIMENTO DELL'ESAME DEVELOPMENT OF THE EXAMINATION
Learning Evaluation Methods.

During the oral examination, students will have to demonstrate that they have acquired a solid knowledge of the legal regulation and the main theoretical-applicative issues of IT law.


Learning Evaluation Criteria.

The mark will be given in thirtieths. Students will pass the exam if they get at least 18. The highest mark is 30 cum laude.


Learning Measurement Criteria.

The mark will be given in thirtieths. Students will pass the exam if they get at least 18. The highest mark is 30 cum laude.


Final Mark Allocation Criteria.

The test is oral and will be conducted in the interview mode. The achievement of the sufficiency (18) requires the demonstration of an adequate knowledge of the topics and property of language. Students who demonstrate critical and analytical ability, as well as a thorough and exhaustive understanding of the theoretical and practical content of the program covered, will obtain the highest mark (30 cum laude).
